FAQ Friday: Bank and POAs

 

On Friday, June 2nd, Our attorney, Mr. Berger discusses what you can do if the bank does not honor your POA.

Your POA should be signed with two witnesses, notarized and while principal is still alive.

Best option includes taking the form in right away while the principal is still healthy instead of waiting until they are sick.

We provide a General Power of Attorney as well as a Maryland Power of Attorney which allow for the representative to execute the bank power of attorney when the bank wants their own completed.

However, if that still isn’t acceptable, you can get a certification from the attorney that it is valid and properly drafted.

There is also a new Maryland power of attorney that is coming out October 1, 2023 that states it is durable if you initial inside the document.
