FAQ Friday: International Wills
On Friday, January 19th, attorney Steven Berger discusses international Wills.
The US has accepted an international treaty, which all states must also accept.
This allows us to create Wills that are also accepted by other countries where you might have other property.
These are great options for countries such as Canada, Mexico, Australia and the United Kingdom.
Taking a close look at the inheritance law in other countries is really important in this situation. Wills can either be completed in each country separating and focusing on the assets in each. Or you can do an international Will encompassing all.
Trusts are much different when discussing other countries. The US rule is that where the property is located is where the probate would occur. However, the US would tax any of your property, no matter the location.
In conclusion, if you have property in Canada, UK, Australia the international Wills statute might be a great option and we can add that onto your Will for an additional $500.
