FAQ Friday: Pre-nuptial Agreements

On Friday, September 26th Mr. Berger discusses pre-nuptial agreements.

We are commonly contacted when there is a second marriage and want to make sure assets that come into marriage stay with their children.

These agreements are important right now, because surviving spouses are now legally entitled to 1/3 of the entire estate. Maintaining this agreement opts out of this law.

To make this agreement, full disclosure of all assets is necessary. Separate consult should be used as well. We tend to refer these requests out to family law attorneys and then we are able to assist both clients when working on estate planning.
